1. Acceptance of Terms

These Terms of Use (“Terms”) govern your use of the AI Video Generator application for iOS (the “App”) provided by Bedouin Apps Ltd. (“we”, “us” or “our”). By downloading or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App. You must be at least 13 years old, or the minimum age required in your country, to use the App.

2. The Service

The App lets you generate videos using artificial intelligence from photos and text you provide. Results are generated automatically, vary, and may be inaccurate, unexpected or not match your request. The App and all generated content are provided “as is”. We may modify, suspend or discontinue any feature, effect or template at any time.

3. Subscriptions and Payments

• The App offers an auto-renewable weekly subscription, purchased through Apple’s In-App Purchase. The price is shown in the App before purchase.
• Payment is charged to your Apple ID account at confirmation of purchase.
• The subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel your subscription in your App Store account settings. Cancellation takes effect at the end of the current period.
• Payments are non-refundable, except as required by Apple’s policies or applicable law. Refund requests are handled by Apple.

4. Credits

• Your subscription includes an allotment of credits for each weekly period. Each generation consumes credits, as shown in the App.
• Credits reset at the start of each period and unused credits do not roll over.
• Credits have no cash value and are not transferable, refundable or exchangeable.
• If a generation fails, the credits used for it are returned to your balance.
• We may change the number of credits included in a subscription or required for a generation.

5. Acceptable Use

You agree not to use the App to upload, create or share content that:

• you do not own or do not have the necessary rights and permissions to use;
• depicts any other person without that person’s consent;
• depicts minors in any sexual, abusive or exploitative context;
• is illegal, hateful, harassing, sexually explicit or violent;
• impersonates any person, or is a deepfake or other deceptive content intended to mislead others;
• infringes the intellectual property, privacy or other rights of others.

You also agree not to reverse engineer, decompile, interfere with, or abuse the App or its services, or attempt to bypass any limits or security measures.

6. Your Content

You retain ownership of the photos and text you submit (“Your Content”). You grant us and our service providers a limited, worldwide, non-exclusive, royalty-free license to host, process, transmit and modify Your Content solely to provide the App’s services to you. You represent that you have all rights and consents needed to submit Your Content, including the consent of every person depicted.

7. Generated Content

Subject to these Terms, applicable law and the rights of others, you may use the videos you generate. Generated content is created by artificial intelligence, may not be unique, and may resemble content generated for others. You are solely responsible for how you use and share generated content, and you must not present it as real in a way that is intended to mislead.

8. Suspension and Termination

We may suspend or terminate your access to the App, without notice, if we reasonably believe you have violated these Terms or applicable law.

9. Intellectual Property

The App, including its software, design, templates and trademarks, is owned by Bedouin Apps Ltd. or its licensors and is protected by intellectual property laws. Except for the limited right to use the App under these Terms, no rights are granted to you.

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY RESULT WILL MEET YOUR EXPECTATIONS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEDOUIN APPS LTD. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS OR GOODWILL, ARISING FROM YOUR USE OF THE APP OR ANY CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP’S SUBSCRIPTION DURING THE THREE (3) MONTHS BEFORE THE CLAIM AROSE.

12. Indemnity

You agree to indemnify and hold harmless Bedouin Apps Ltd. from any claims, damages or expenses arising from Your Content, your use of generated content, or your violation of these Terms.

13. Changes

We may update these Terms or change the App at any time. Changes take effect when posted on this page, and the “Last updated” date will be revised. Continued use of the App means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws applicable in the jurisdiction where Bedouin Apps Ltd. is registered, without regard to conflict-of-law rules, except where mandatory consumer protection laws of your country provide otherwise.

15. Apple Terms

These Terms are between you and Bedouin Apps Ltd., not Apple. Apple is not responsible for the App or its content. Apple’s Licensed Application End User License Agreement also applies to your use of the App.

1. قبول الشروط

تحكم شروط الاستخدام هذه («الشروط») استخدامك لتطبيق «مولد فيديو AI» (AI Video Generator) على نظام iOS («التطبيق») المقدَّم من شركة Bedouin Apps Ltd. («نحن» أو «الشركة»). وبتنزيلك التطبيق أو استخدامه فإنك توافق على هذه الشروط وعلى سياسة الخصوصية الخاصة بنا. وإن لم توافق عليها فلا تستخدم التطبيق. ويجب ألا يقل عمرك عن 13 عامًا أو عن الحد الأدنى للسن المقرر في دولتك لاستخدام التطبيق.

2. الخدمة

يتيح لك التطبيق إنشاء مقاطع فيديو بالذكاء الاصطناعي انطلاقًا من الصور والنصوص التي تقدمها. وتُنشأ النتائج آليًا، وهي متفاوتة وقد تكون غير دقيقة أو غير متوقعة أو غير مطابقة لطلبك. ويُقدَّم التطبيق وجميع المحتوى المُنشأ «كما هو». ويحق لنا تعديل أي ميزة أو مؤثر أو قالب أو تعليقه أو إيقافه في أي وقت.

3. الاشتراكات والمدفوعات

• يوفّر التطبيق اشتراكًا أسبوعيًا يتجدد تلقائيًا، ويُشترى عبر خدمة الشراء داخل التطبيق من Apple. ويُعرض السعر داخل التطبيق قبل الشراء.
• يُخصم المبلغ من حساب Apple ID الخاص بك عند تأكيد الشراء.
• يتجدد الاشتراك تلقائيًا ما لم يُلغَ قبل 24 ساعة على الأقل من نهاية الفترة الحالية، ويُخصم رسم التجديد من حسابك خلال الـ 24 ساعة السابقة لنهاية الفترة الحالية.
• يمكنك إدارة اشتراكك أو إلغاؤه من إعدادات حسابك في App Store، ويسري الإلغاء في نهاية الفترة الحالية.
• المبالغ المدفوعة غير قابلة للاسترداد، إلا وفقًا لسياسات Apple أو ما يقتضيه القانون المعمول به، وتتولى Apple معالجة طلبات الاسترداد.

4. وحدات الرصيد (الكريدت)

• يتضمن اشتراكك عددًا محددًا من وحدات الرصيد لكل فترة أسبوعية، وتستهلك كل عملية إنشاء عددًا من الوحدات وفق ما هو معروض في التطبيق.
• يُعاد تعيين الرصيد في بداية كل فترة، ولا تُرحَّل الوحدات غير المستخدمة إلى الفترة التالية.
• ليست لوحدات الرصيد أي قيمة نقدية، ولا يجوز نقلها أو استردادها أو استبدالها.
• إذا فشلت عملية إنشاء، تُعاد الوحدات المستخدمة فيها إلى رصيدك.
• يحق لنا تغيير عدد الوحدات المشمولة في الاشتراك أو المطلوبة لعملية الإنشاء.

5. الاستخدام المقبول

توافق على عدم استخدام التطبيق لرفع أو إنشاء أو مشاركة أي محتوى:

• لا تملكه أو لا تملك الحقوق والأذونات اللازمة لاستخدامه؛
• يُظهر أي شخص آخر دون موافقته؛
• يُظهر قاصرين في أي سياق جنسي أو مسيء أو استغلالي؛
• غير قانوني أو يحض على الكراهية أو ينطوي على تحرش أو محتوى جنسي صريح أو عنف؛
• ينتحل شخصية أي شخص، أو يُعدّ تزييفًا عميقًا (Deepfake) أو محتوى خادعًا يُقصد به تضليل الآخرين؛
• ينتهك حقوق الملكية الفكرية أو الخصوصية أو غيرها من حقوق الآخرين.

كما توافق على عدم إجراء هندسة عكسية للتطبيق أو خدماته أو تفكيكها أو التدخل فيها أو إساءة استخدامها، أو محاولة تجاوز أي قيود أو تدابير أمنية.

6. المحتوى الخاص بك

تظل مالكًا للصور والنصوص التي ترسلها («المحتوى الخاص بك»). وتمنحنا ومزوّدي خدماتنا ترخيصًا محدودًا وعالميًا وغير حصري وخاليًا من الرسوم لاستضافة المحتوى الخاص بك ومعالجته ونقله وتعديله، وذلك لغرض تقديم خدمات التطبيق لك فقط. وتقرّ بأنك تملك جميع الحقوق والموافقات اللازمة لإرسال المحتوى الخاص بك، بما في ذلك موافقة كل شخص يظهر فيه.

7. المحتوى المُنشأ

مع مراعاة هذه الشروط والقانون المعمول به وحقوق الآخرين، يجوز لك استخدام مقاطع الفيديو التي تنشئها. والمحتوى المُنشأ من إنتاج الذكاء الاصطناعي، وقد لا يكون فريدًا، وقد يشبه محتوى أُنشئ لمستخدمين آخرين. وتتحمل وحدك المسؤولية عن كيفية استخدامك للمحتوى المُنشأ ومشاركته، ولا يجوز لك تقديمه على أنه حقيقي بقصد التضليل.

8. تعليق الخدمة وإنهاؤها

يحق لنا تعليق وصولك إلى التطبيق أو إنهاؤه دون إشعار مسبق إذا كان لدينا اعتقاد معقول بأنك خالفت هذه الشروط أو القانون المعمول به.

9. الملكية الفكرية

التطبيق، بما في ذلك برمجياته وتصميمه وقوالبه وعلاماته التجارية، مملوك لشركة Bedouin Apps Ltd. أو للجهات المرخِّصة لها، ومحمي بموجب قوانين الملكية الفكرية. ولا تُمنح لك أي حقوق باستثناء الحق المحدود في استخدام التطبيق وفقًا لهذه الشروط.

10. إخلاء المسؤولية

إلى أقصى حد يسمح به القانون، يُقدَّم التطبيق وجميع المحتوى «كما هو» و«حسب توفره»، دون أي ضمانات من أي نوع، صريحة كانت أو ضمنية، بما في ذلك ضمانات القابلية للتسويق والملاءمة لغرض معين وعدم الانتهاك. ولا نضمن أن يعمل التطبيق دون انقطاع أو أخطاء، أو أن تلبي أي نتيجة توقعاتك.

11. تحديد المسؤولية

إلى أقصى حد يسمح به القانون، لا تتحمل شركة Bedouin Apps Ltd. أي مسؤولية عن أي أضرار غير مباشرة أو عرضية أو خاصة أو تبعية أو عقابية، أو عن أي خسارة في البيانات أو الأرباح أو السمعة، تنشأ عن استخدامك للتطبيق أو لأي محتوى. ولا يتجاوز إجمالي مسؤوليتنا عن أي مطالبة المبلغَ الذي دفعته مقابل اشتراك التطبيق خلال الأشهر الثلاثة (3) السابقة لنشوء المطالبة.

12. التعويض

توافق على تعويض شركة Bedouin Apps Ltd. وإبراء ذمتها من أي مطالبات أو أضرار أو نفقات تنشأ عن المحتوى الخاص بك، أو عن استخدامك للمحتوى المُنشأ، أو عن مخالفتك لهذه الشروط.

13. التعديلات

يحق لنا تحديث هذه الشروط أو تغيير التطبيق في أي وقت، وتسري التعديلات فور نشرها على هذه الصفحة مع تحديث تاريخ «آخر تحديث». ويُعدّ استمرارك في استخدام التطبيق قبولًا للشروط المحدّثة.

14. القانون الحاكم

تخضع هذه الشروط للقوانين المعمول بها في الولاية القضائية التي سُجّلت فيها شركة Bedouin Apps Ltd.، دون اعتبار لقواعد تنازع القوانين، إلا حيث تقضي قوانين حماية المستهلك الإلزامية في دولتك بخلاف ذلك.

15. شروط Apple

هذه الشروط مبرمة بينك وبين شركة Bedouin Apps Ltd.، وليست Apple طرفًا فيها، ولا تتحمل Apple أي مسؤولية عن التطبيق أو محتواه. وتسري كذلك على استخدامك للتطبيق اتفاقية ترخيص المستخدم النهائي للتطبيقات المرخّصة الخاصة بـ Apple.
